Imagine your commute to work.\u00a0 You drive every day.\u00a0 Your commute started getting longer and longer.\u00a0 The commute is eating into your free time.\u00a0 What happens?\u00a0 Technology gives you a solution: an application that allows users to share real-time traffic information.\u00a0 This information allows users to explore alternative routes with less traffic.\u00a0 These alternative routes are shorter in comparison to your current commute.<\/p>\n

But, something starts to change.\u00a0 As more people learn about this new app and your new favorite shortcut, others start using the same shortcut.\u00a0 Once again, your commute is miserable.<\/p>\n

Something similar happened in patent litigation.\u00a0 VE Holding Corp. v. Johnson Gas Appliance Co.<\/em> is a Federal Circuit case that, similarly to the app above, created a route for litigation parties to file their cases in any federal court.\u00a0 Non-practicing entities (\u201cNPEs) used VE Holding<\/em> to file complaints at the Eastern District of Texas.\u00a0 NPEs used this route, they used it often, and they used it well.<\/p>\n

NPEs are not viewed kindly in the intellectual property community because, among other things, they found a way to use the Federal Circuit\u2019s finding in VE Holding<\/em> to their advantage using it as a shortcut to bring patent infringement suits against alleged infringers in EDTX.\u00a0 At first, litigation in the EDTX moved fast.\u00a0 However, more parties started filing their patent infringement cases there to the point of creating congestion in a court that once had a reputation for having a rocket docket.\u00a0 Like your commute, things started slowing down at the EDTX.<\/p>\n

The TC Heartland<\/em> Supreme Court decision curtailed this \u201cshortcut\u201d by establishing that \u201cvenue\u201d for patent infringement cases is governed by 28 U.S.C. \u00a7 1400(b).\u00a0 Section 1400(b) establishes that any civil action for patent infringement may be brought in the judicial district where the defendant resides, or where the defendant has committed acts of infringement and has a regular and established place of business.<\/p>\n
